What is CBAM and who does it affect?
The Carbon Border Adjustment Mechanism (CBAM) is an EU instrument that has been fully in force since January 2026. It requires importers of steel, aluminium, cement, fertilisers, hydrogen and electricity to purchase EU certificates corresponding to the carbon content of the imported goods.
Which goods are subject to CBAM?
CBAM currently covers the following sectors: iron and steel, aluminium, cement, fertilisers, hydrogen and electricity. The European Commission is reviewing a gradual extension to further sectors from 2030.
What are embedded emissions?
Embedded emissions are the CO₂ emissions that arise during the manufacture of a product. For CBAM, importers must demonstrate these emissions – either with data from the manufacturer or using EU default values.
When must CBAM declarations be submitted?
From 2026, authorised CBAM declarants must submit the CBAM declaration for the previous year annually by 31 May and surrender the corresponding certificates. The first full declaration for 2026 is due by 31 May 2027.
Do I need an EU Representative for CBAM?
Companies without an EU establishment cannot act directly as a CBAM declarant. They need an indirect customs representative with an EU EORI number who assumes the CBAM obligations on their behalf. ArtemLEX offers this service as an EU Representative.
